Why register a trademark in Sri Lanka?

Trademark registration in India

Why register a trademark in India?

Trademark registration is not compulsory in order to use a brand in India. Unregistered trade marks may be protected by the local courts. The relief available where the courts find an unregistered trademark to have been infringed include: an injunction restraining further use of the mark; damages; an account of profits; and an order for delivery of the infringing labels and marks for destruction by the rightful user of the brand.

However, trademark registration confers a number of commercial and legal benefits on the owner that make it the most attractive method of brand protection. Most obviously, the trade mark owner enjoys the exclusive right to use the registered mark in India. It becomes their property, with all of the benefits this entails, including the right to sell or license it to others for a profit. (more…)
