Why register a trademark in Russia?

In Russia, rights in your brand enforceable against infringers will only be recognised by the courts if you have registered your trademark.

Besides this fact, trademark registration is often very beneficial to the owner. Investment made in the promotion of your product or service can be centred on a memorable brand. In time, this investment may lead to consumers gravitating towards goods and services marketed under your brand. This is particularly likely where the consumer has become enamoured with the quality of your produce. A just reward for producing a quality product, and for carefully marketing it, therefore, should be the enhanced profitability that comes with being regarded favourably by the public.

To ensure that no one tries to ‘free-ride’ on another’s hard earned place in the market, the law grants the trade mark owner the exclusive right to use the registered mark in Russia. It becomes their property, with all of the benefits this entails, including the right to sell or license it to others for a profit. (more…)

Why register a trademark in Bulgaria?

Trademark registration is not required in order to use a mark in Bulgaria. However, rights to prevent third parties from also making use of the mark are generally only acquired by registering it. Until you do so, there is a risk that your brand could be appropriated by another trader effecting the trademark registration first. They would then be able to prevent you from continuing to use your brand, even if you have been using it for many years and have invested a considerable amount in its development.  Usually, such behaviour is motivated by the desire to extract a profit from the rightful owner of the mark. If your mark is particularly well-known, then it may be entitled to some protection before registration, but enforcement of such protection entails considerable expenditure of time and money.
